Terms of Service

1. Acceptance of Terms

By accessing or using LoveBoard ("the Service"), operated by Better Version, Inc., a Delaware corporation ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service, including workspace owners, team members, and visitors.

2. Description of Service

LoveBoard is a testimonial management platform that enables businesses to collect, manage, and display social proof. The Service includes testimonial collection forms, in-browser video recording, embeddable widgets, multi-workspace management, and a centralized dashboard.

3. Account Registration

To use the Service, you must:

  • Be at least 16 years old
  • Provide accurate, complete, and current registration information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.

4. Workspaces and Teams

The Service allows you to create workspaces and invite team members. As a workspace owner, you are responsible for managing access, roles, and permissions within your workspace. You are also responsible for the actions of your team members within the workspace. Each workspace is fully isolated — data, testimonials, and settings are not shared between workspaces.

5. User Content

You retain ownership of all content you submit to the Service ("User Content"), including testimonials, videos, images, and text. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your User Content solely for the purpose of providing the Service.

You represent and warrant that:

  • You own or have the necessary rights to submit the User Content
  • Your User Content does not violate any third-party rights
  • Your User Content is not unlawful, defamatory, or otherwise objectionable
  • You have obtained proper consent from individuals whose testimonials you collect through the Service

6. Testimonial Collection

When using the Service to collect testimonials from your customers, you are responsible for ensuring compliance with all applicable privacy and data protection laws. This includes obtaining necessary consent from individuals before collecting their testimonials, informing them about how their data will be used, and providing them with the ability to request removal. You are the data controller for any personal data collected through your collection forms; LoveBoard acts as a data processor on your behalf. Our Data Processing Agreement is available at loveboard.io/dpa.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe on any third-party intellectual property rights
  • Transmit malware, viruses, or other harmful code
  • Send spam or unsolicited communications
  • Impersonate another person or entity
  • Collect fake or misleading testimonials
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to harass, abuse, or harm another person
  • Scrape or extract data from the Service through automated means without our permission

8. Payment and Billing

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees. All fees are non-refundable unless otherwise stated or required by applicable law (see Section 20 for additional rights that may apply to EU consumers). We reserve the right to change our pricing with 30 days' notice. If you do not agree to the new pricing, you may cancel your subscription before the next billing cycle.

Lifetime deals purchased through third-party marketplaces (such as AppSumo) are subject to their respective terms and refund policies during the applicable refund window. After the refund window closes, lifetime deal holders retain access to the features included in their plan at the time of purchase for the lifetime of the Service. LoveBoard reserves the right to define which features are included in each lifetime deal tier. New features released after purchase may or may not be included at our discretion.

9. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or other operational reasons. We will make reasonable efforts to provide advance notice of planned downtime.

10. Cancellation and Termination

You may cancel your account at any time from your workspace settings. Upon cancellation, your access to paid features will continue until the end of the current billing period. We may suspend or terminate your account if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination.

Upon account deletion, all personal data, workspace data, and testimonial data (including media files) will be permanently deleted within 30 days, except where we are required to retain it by law. Testimonial data collected on behalf of your customers through your collection forms is also deleted as part of this process.

11. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Better Version, Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent. The LoveBoard name, logo, and related marks are our trademarks.

12. Copyright and Takedown Requests

We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, you may submit a takedown request to hello@loveboard.io with the following information:

  • A description of the copyrighted work you claim has been infringed
  • The URL or location of the allegedly infringing content on our Service
  • Your contact information (name, address, email, phone number)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
  • Your physical or electronic signature

We will review and respond to valid takedown requests in accordance with the Digital Millennium Copyright Act (DMCA).

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

14. Limitation of Liability

To the maximum extent permitted by law, Better Version, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Better Version, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms to the extent that such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, strikes, power outages, internet or telecommunications failures, or cyberattacks.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting a notice on the Service or sending you an email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

18. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may pursue mediation before a mutually agreed-upon mediator. If mediation fails, the dispute shall be submitted to the state or federal courts located in Delaware, and both parties consent to the exclusive jurisdiction of those courts.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.

20. Additional Terms for EU Consumers

If you are a consumer located in the European Economic Area (EEA) or United Kingdom, the following additional terms apply:

  • Nothing in these Terms affects your statutory rights as a consumer under applicable EU or member state law, including the Consumer Rights Directive.
  • You have the right to withdraw from a paid subscription within 14 days of purchase without giving a reason. To exercise this right, contact us at hello@loveboard.io. If you have actively used the Service during the withdrawal period, we may charge a proportionate amount for the service provided up to that point.
  • Any disputes may be brought before the competent courts of your country of residence, in addition to or instead of the courts specified in Section 18.
  • The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. Any attempted assignment in violation of this section is void.

22. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Data Processing Agreement, constitute the entire agreement between you and Better Version, Inc. regarding your use of the Service and supersede all prior agreements and understandings.
